Claims to treat or prevent morning sickness or the symptoms of morning sickness are likely to be medicinal. Marketers wanting to advertise treatments for this condition should consult the Medicines and Healthcare products Regulatory Agency (MHRA) to ensure they are not making medicinal claims. See ‘Medicinal Claims’.
Marketers may market vitamins and minerals to nauseous expectant mothers but should first check with the MHRA to ensure their product is neither medicinal by function nor medicinal by presentation. As long as they are not, marketers may advertise their products if they comply with rules 15.1.1, 15.7 and 15.8.
